What gets covered today has to be provable ten years from now.
Article 18 of the Chilean Urban Planning and Construction Act makes the first-seller owner liable for load-bearing structure defects for ten years from final acceptance. Today that proof is a photo of a paper protocol in a WhatsApp group.
What happens today
- The concrete protocol is filled on site, signed, photographed and sent by WhatsApp. The photo gets compressed and the specimen number stops being legible.
- The inspector’s observation is closed out, but the evidence that it was closed lives in three separate emails and an undated photo.
- The final acceptance file is assembled two weeks before handover, hunting for paperwork from two years ago.
